We recommend obtaining qualified legal advice as soon as possible in cases of building or buying an apartment. During this phase, we draw up and examine the statement of partition under current WEG, which splits the ownership of the real estate between individual apartment owners, and we assess the declaration of restrictions regulating the relationship between these individual apartment owners. A clear and unambiguous contract contributes substantially toward avoiding any future legal disputes.
We clearly and comprehensively explain to property management agencies and apartment owners the specifications of convocation, implementation and the adoption of decisions at owners’ meetings. Examination of the validity of the decisions made and their contention is our primary focus in this area.
In addition, our advice service also covers the regulation of claims that apartment owners may have against each other. This includes not only the regulation of burden-sharing and possible rebuttal claims against other apartment owners (e.g. on grounds of structural changes or the transgressions by other apartment owners regarding the use of the property), but also the apartment owners’ options regarding withdrawal of ownership of the property. Such withdrawal could be considered, for instance, in a case of repetitive grave breach of duty.
We also regulate the claims of apartment owners and administrators. First and foremost here is the duty to provide information or justification, e.g. provision of receipts, the carrying out of maintenance or repair work, or duties arising from the decisions made at the owners’ meetings.
