An alimony claim can arisefrom a contractual agreement or by law. Legal alimony obligations exist between spouses / common law partners, as well as between direct relatives in a straight line. The obligation to provide alimony arises for spouses and partners by marriage or by conclusion of a partnership. The term „relatives in a straight line“ applies especially to parents and their children. However, an alimony claim is only justified if the claimant is in need and the other party has the financial capacity. This is not easy to estimate by outsiders. It can often result in family disputes. In this case it is advisable for the parties concerned not to conclude any alimony agreements without legal advice.
